The Gap

“Supplement the records with physician-verified opinions on causation and timeline, and answer the defense's arguments before they're made.”

The Document

What the Summary Report contains

Every Summary Report is written by a board-certified physician who has read the complete file and spoken with your client. Sections vary by jurisdiction and case type, but the architecture is consistent.

The Adjuster's Playbook

Records alone don't just get undervalued — they get argued down five specific ways.

Here is what actually happens to a bare-records demand once it lands on an adjuster’s desk, and what the Summary Report is written to answer before the defense raises it.

TacticHow the Summary Report Answers It

Gap in treatment

“If it were that serious, they wouldn't have waited three weeks to see a doctor.”

Explains, medically, why the gap happened — cost, work schedule, or the client not recognizing severity — before the defense raises it.

Degenerative / age-related wear

“The imaging shows arthritis — that's aging, not the accident.”

Rules out age-related wear as the more probable cause, using a documented before-and-after timeline.

“Hired gun” pushback

“This is a rubber-stamp opinion bought by the plaintiff's lawyer.”

Discloses exactly which records were reviewed and how the interview was conducted — it can't be waved away as unsupported.

Low-impact damage

“Minor bumper damage — there's no way this caused a real injury.”

Ties injury severity to the physiology of the mechanism, not cosmetic vehicle damage — breaking the small-crash assumption.

Surveillance & social mining

“We have photos of the client smiling at a birthday party — they're not really hurt.”

Documents functional loss in the client's own words plus clinical findings, so a single photo can't undercut the claim.

Causation

“Nothing in these records says the accident caused this.”
A board-certified physician states causation for each injury to a reasonable degree of medical probability — the opinion treating records rarely provide.
Three ways adjusters argue causation down
Degenerative / age-related wear
“The imaging shows arthritis — that's aging, not the accident.”
Addresses pre-existing and degenerative findings within the causation analysis, using prior records where available and your client's account.
Gap in treatment
“If it were that serious, they wouldn't have waited three weeks to see a doctor.”
Explains whether delayed symptoms or care are medically consistent with the injuries, alongside your client's own reasons.
Low-impact damage
“Minor bumper damage — there's no way this caused a real injury.”
Explains whether the injuries are medically consistent with the reported mechanism, based on the medicine, not the bumper.

Cost & Credibility

“Even if the accident caused it, the bills are inflated and the report is bought.”
A board-certified physician itemizes future care, gives an opinion on the specials to date, and ties the conclusions to your client's own treating providers.
Three ways adjusters argue cost and credibility down
Future medical care
“Future treatment is speculative — we're only paying what's been billed.”
Itemizes future care and cost across every affected specialty, so your demand carries a documented figure.
Overtreatment / bill reductions
“That's too much therapy — we're cutting the chiropractic bills.”
A physician's opinion on the reasonableness and necessity of your client's specials to date.
“Hired gun” pushback
“This is a rubber-stamp opinion bought by the plaintiff's lawyer.”
Ties the opinions to your client's own treating providers and includes the reviewer's CV, so the conclusions rest on the record.

The Summary Report is prepared for demand and settlement purposes. If a case moves toward trial, we can place a subspecialty-matched, examination-based expert instead.

Practice Areas

Where the Summary Report Fits

Personal Injury

The core use case, available in all 50 states. The causation analysis is written to support your comparative-negligence position in states that reduce recovery by assigned fault — not just to document the injury in isolation.

Medical Malpractice

Damages side only. Malpractice cases turn on two separate questions — was the standard of care breached, and what did the breach cost your client. The Summary Report speaks only to the second: once liability is established through your same-specialty affidavit, certificate of merit or expert affidavit, it builds the injury-by-injury causation chain, permanency findings and future-care projection that convert a liability finding into a settlement number. It is not a standard-of-care opinion and does not substitute for the liability expert your jurisdiction requires to file.

Workers' Compensation

Available in every state except California. Comp systems regulate med-legal reporting differently — your case specialist will confirm exactly how it can be used in your venue before you order.
